Terms of Use

PLEASE READ THESE TERMS OF USE CAREFULLY. These terms govern your access to and use of the websites operated by End of Three Enterprises, LLC (the "Company", "we", "us"), including garagegymathlete.com and endofthreefitness.com and their subdomains (the "Site"), and the Garage Gym Athlete app, available on the web at app.garagegymathlete.com and as an iOS and Android app (the "App"). By using the Site or the App, or by creating an account, you agree to these Terms of Use. If you do not agree, do not use the Site or the App.

1. Eligibility

The Site and the App are intended for adults. You must be at least 18 years old to create an account or purchase a membership. By creating an account you represent that you are at least 18 years old.

2. Your account

You are responsible for your account, for keeping your login credentials secure, and for all activity that happens under your account. Provide accurate information and keep it current. Notify us at support@garagegymathlete.com if you believe your account has been accessed without your permission. You may delete your account at any time; see our account deletion page.

3. Membership, billing, and cancellation

Parts of the App require a paid membership. The exact price, any free trial, and the billing period are shown to you before you subscribe, and the terms presented at signup govern your membership. As of the date of these terms, membership is offered as a monthly subscription with a 7 day free trial, and as an annual subscription.

  • Auto-renewal. Memberships renew automatically at the end of each billing period (monthly or yearly) until you cancel. If your plan includes a free trial, your paid subscription starts automatically when the trial ends unless you cancel before the end of the trial.
  • How to cancel. If you subscribed through our website or the web app, cancel any time from Account & Settings in the App using Manage membership, or contact us atsupport@garagegymathlete.com. If you subscribed through the Apple App Store or Google Play, cancel through your App Store or Google Play subscription settings; store subscriptions are managed by Apple or Google and follow their terms. Cancellation stops future renewals; you keep access through the end of the period you have paid for.
  • Price changes. We may change membership pricing. Price changes take effect at your next renewal, and we will give you advance notice before a change applies to you.
  • Refunds. If something is not right, contact us atsupport@garagegymathlete.com within 30 days of a charge and we will work with you. Refunds beyond that window are at the Company's discretion. Purchases made through the Apple App Store or Google Play are refunded by Apple or Google under their refund policies.
  • Legacy purchases. If you purchased a membership or program on an earlier Company platform, contact us and we will connect it to your App account.

4. Health and fitness disclaimer

The App and the Site provide fitness programming, educational content, and general information. They do not provide medical advice, and they are not a substitute for the advice, diagnosis, or treatment of a physician or other qualified health provider.

Before starting any exercise or nutrition program, including ours, get a medical examination or your doctor's approval, especially if you have any medical condition, injury, or symptom. Exercise carries inherent risk of injury. By using the App you accept that risk, agree that your training decisions are your own, and agree to stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or any concerning symptom.

To the fullest extent permitted by law, the Company, its owners, employees, coaches, and partners are not liable for any injury, health problem, or damages of any kind that result from your use of the programming, content, or advice available through the Site or the App, whether during or after any training or nutrition change. Company employees are not licensed medical providers, registered dietitians, or nutritionists, and can only provide general, non-medical guidance. Any person with a medical condition or unexplained symptoms should consult their doctor.

5. Community and content you post

The App includes community features: posts, comments, reactions, photos, and direct messages ("Member Content"). You own your Member Content. By posting it, you grant the Company a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute that content within the Site and the App for the purpose of operating the service. This license ends when your content or your account is deleted, except where content has been shared with or re-shared by others, or where we must retain it to comply with law.

We have zero tolerance for objectionable content and abusive behavior. You agree not to post content that is illegal, threatening, harassing, hateful, pornographic, or that infringes anyone's rights, and not to use the community to spam, impersonate, or abuse other members. The App provides tools to report content and members and to block members. We review reports and may remove content, restrict features, suspend, or terminate accounts at our sole discretion, without notice, for conduct that violates these terms or harms the community.

6. License to use the App and our content

Subject to these terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site, the App, and the content we make available through them (programming, videos, training materials, text, graphics, and other materials, collectively the "Content") for your personal, non-commercial use. Membership Content is available for the duration of your membership.

All Content is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. The names and marks "Garage Gym Athlete" and "End of Three Fitness" are trademarks of the Company. You may not copy, reproduce, republish, upload, post, transmit, distribute, sell, or use any Content for public or commercial purposes without the Company's express written permission. If you believe your intellectual property rights are being violated on the Site or in the App, notify us atsupport@garagegymathlete.com with your contact information, a description of the work and the claimed violation, and the location of the material.

7. Feedback

If you send us ideas, suggestions, or feedback about the Site or the App, we may use them without restriction or compensation to you. This section does not apply to your Member Content, which is covered by Section 5.

8. Electronic communications

When you create an account, you consent to receive service notices, agreements, disclosures, and other communications from the Company electronically, including by email and by notifications in the App. You can control marketing and community email and push notification preferences in Settings, and every marketing email includes an unsubscribe link.

9. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Site or the App you accept the Privacy Policy.

10. Third-party services and app stores

The Site and the App rely on third-party services, including payment processing and app distribution. Problems caused by a third-party provider are governed by your agreement with that provider. If you downloaded the App from the Apple App Store or Google Play, your use of the App is also subject to that store's terms, and Apple and Google are not parties to these Terms of Use and are not responsible for the App or its content.

11. Disclaimer of warranties

ALL CONTENT, THE SITE, AND THE APP ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT THAT THE SITE OR THE APP WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE, THE APP, OR THE CONTENT ARE FREE FROM BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS. THE COMPANY MAKES NO WARRANTY REGARDING THE RESULTS OF USING THE CONTENT, INCLUDING FITNESS RESULTS, WHICH DEPEND ON FACTORS INDIVIDUAL TO YOU. NO SYSTEM IS ENTIRELY SECURE, AND YOU ACKNOWLEDGE THAT UNAUTHORIZED THIRD PARTIES MAY ATTEMPT TO ACCESS DATA; USE OF THE SITE AND THE APP IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ANY PARTY INVOLVED IN CREATING, PRODUCING, OR MAINTAINING THE SITE OR THE APP BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE, OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING BUT NOT LIMITED TO DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, OR CLAIMS ARISING FROM SERVICE INTERRUPTIONS, OCCASIONED BY ANY DEFECT IN THE SITE, THE APP, THE CONTENT, OR ANY OTHER CAUSE, REGARDLESS OF THEORY OF LIABILITY. THIS LIMITATION APPLIES EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify and hold the Company and each of its directors, officers, employees, and agents harmless from any and all liabilities, claims, damages, and expenses, including reasonable attorney's fees, arising out of or relating to (i) your breach of these terms, (ii) any violation by you of law or the rights of any third party, (iii) any Member Content you post or share, (iv) your use of the Site or the App, and (v) your conduct in connection with other users. The Company reserves the right to assume the exclusive defense of any claim for which it is entitled to indemnification, in which case you agree to cooperate with the Company's defense.

14. Termination

The Company may limit, suspend, or terminate your access to the Site, the App, or your account if you violate these terms, or where reasonably necessary to protect the Company, the community, or the service. You may stop using the Site and the App, and delete your account, at any time. Sections that by their nature should survive termination (including Sections 4, 5 license as limited there, 6, 11, 12, 13, and 15) survive.

15. Governing law

These terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You submit to the exclusive jurisdiction of the state and federal courts sitting in Orange County, California. If any provision of these terms is unlawful, void, or unenforceable, that provision is severable and does not affect the validity of the remaining provisions.

16. Changes to these terms

We may revise these Terms of Use from time to time by updating this page. The version and date below change when we do, and for material changes we will provide notice in the App or by email. Your continued use of the Site or the App after changes take effect means you accept the revised terms. These terms, together with the Privacy Policy and the subscription terms presented at signup, are the entire agreement between you and the Company regarding the Site and the App, and supersede prior agreements on that subject.

Affiliate Disclosure

Garage Gym Athlete (End of Three Enterprises, LLC) participates in affiliate programs, including the Rogue Fitness affiliate program and the Amazon Services LLC Associates Program. Some links on this site, mostly to Rogue Fitness and Amazon, are affiliate links: if you click one and make a purchase, we earn a commission at no additional cost to you. As an Amazon Associate we earn from qualifying purchases.

Commissions never change what we recommend. We link gear we train with, and pages that contain affiliate links carry a one-line disclosure at the top that points back here.
